MISSOULA, Mont. — A district court judge in Gallatin County said Montana’s ban on transgender athletes in college sports is unconstitutional.
The state legislature passed House Bill 112, also called the Save Women’s Sports Act, in 2021.
The law bans transgender athletes from participating on school sports teams of the gender with which they identify.
According to a court order signed on Wednesday, the bill is unconstitutional as it pertains to institutions of higher learning.
The judge wrote that the bill infringes upon the Montana University System Board of Regent’s constitutional authority.
